Simplified Hindu Adoption of Orphans in India

The Challenge
India, often referred to as the “orphan capital of the world”, is home to 3.1 crore orphans, according to Parliamentary Committee (Rajya Sabha) Report, August 2022
Tragically, only about 4,029 adoptions took place in the year 2023-2024 (https://cara.wcd.gov.in/resource/adoption_Statistics.html) one adoption per 8,000 orphans. Simultaneously, a huge majority from 2.75 crore infertile couples in India wish to adopt, but complex laws and procedures hinder the process.
Our Efforts
Through our organization, Temple of Healing, we’ve tirelessly worked to simplify adoption laws. Despite several discussions with the Ministry of Women and Child Development, actionable change remains elusive. Consequently, we filed a Public Interest Litigation (PIL1003/2021) in September 2021 in the Hon’ble Supreme Court of India. We had more than 12 hearings. The secretary of the organization, Dr Piyush Saxena himself, as petitioner in person, presented the matter in front of Hon’ble Court.
Key Legal Breakthroughs
The Hon’ble Supreme Court has clarified that as per Section 56(3) of the Juvenile Justice Act of 2015), “Nothing in this Act shall apply to the adoption made under the provisions of Hindu Adoption and Maintenance Act (HAMA) of 1956”.
Based on customs, usage and practices, the HAMA adoption process includes:
- Transfer of child from biological to adoptive parents and/or
- A notarized and registered adoption deed and/or
- District Magistrate approval for formal documentation.
This ruling, outlined in the court’s interim orders dated 20/11/2023 and 09/07/2024 and also our IA dated 06/02/2024, provide a significant opportunity for prospective adoptive Hindu parents.
