India is orphan capital of the world. Based on Parliamentary Committee (August 2022) Report on Adoption Laws, India has 3.1 crore orphans. Annual adoption has been close to 3,100 as reported by the learned ASG. This is approximately 1 adoption per 10,000 orphans.
As reported by the daily newspaper, “The Diplomat” 2.75 crore infertile couples are keen to adopt a baby.
For resolution of complex laws, we held several meetings with the Ministry of Women and Child Development, New Delhi.
Finally we filed a PIL in Sept 2021 in the Hon’ble Supreme Court.
Please refer to the interim order dated 20/11/2023 of the Hon’ble Supreme Court. It is clear that the provisions J J Act 2015 does not apply [(section 56(3)], to the Hindu adoptions as covered by HAMA 1956. Needless to state that the HAMA adoption process is simple.
